PIONEER BONUS BUCKS PROGRAM TERMS AND CONDITIONS 

  1. The Pioneer Bonus Bucks Program (the "Program") is a loyalty reward program that is operated by Pioneer Energy ("Pioneer"). The Program operates only through participating Pioneer stations and/or the businesses of third party vendors authorized by Pioneer for the distribution and/or redemption of Bonus Bucks (to obtain an up-to-date list of participating locations, please contact us at info@pioneer.ca). In using a Pioneer Bonus Bucks Card, you are deemed to have agreed to the Terms and Conditions of the Program outlined below.

HOW TO ENROLL IN THE PROGRAM
  1. You must be 13 years or older and you can obtain a Pioneer Bonus Bucks Card at any participating Pioneer station simply by requesting one. The person ("Participant") receiving this primary Card. The Card may only be used once the attendant at the station activates it by electronically "reading" it into the Pioneer computer system at the same time the recipient makes their first purchase. Once activated, Bonus Bucks will begin to accrue to that Card. However, the cardholder will not be able to redeem Bonus Bucks until the cardholder registers the Card online, by telephone or fully completing the Program registration form and forwarding it to Pioneer by fax or mail. Please be aware that some promotions, offers, and items for redemption are available only to those 18 or 21 years or older.

    The back of the primary Card will bear a preprinted temporary password that will permit the Participant to access their Bonus Bucks account online at the Pioneer Website. The temporary password becomes active as soon as the Card associated with that password has been activated by a Pioneer station attendant. For the Participant's own protection the Participant MUST change the temporary password into a "personalized" password as soon as possible (this may be done while registering the Card online or by contacting the Pioneer Customer Service at the telephone number located at the end of these Terms and Conditions). A temporary password automatically becomes disabled once a personalized password is created. A personalized password may be changed at any time by telephoning the Pioneer Customer Service or by the Participant signing in online to their Bonus Bucks account and changing the password themselves. Should the Participant forget their temporary or personalized password, a new one will be issued by the Pioneer Customer Service after that Customer Service has been contacted by telephone. A Participant can also have their password emailed to them if they have provided the necessary information for an automatic password recovery (challenge question, challenge answer, date of birth and email address). In the event that a temporary or personalized password is forgotten, misplaced, lost, stolen or is used in any unauthorized way, a new password will be provided to the Participant once the Pioneer Customer Service is informed thereof by telephone and Pioneer will at that time disable the old password. It is the responsibility of the Participant to ensure that their password is adequately protected at all times; PIONEER ASSUMES NO LIABILITY FOR THE UNAUTHORIZED USE OF ANY PASSWORD REGARDLESS OF THE CIRCUMSTANCES.


    TIPS FOR YOUR PERSONALIZED PASSWORD:
    When selecting a personalized password, never use obvious information such as a telephone number, date of birth, address or social insurance number. NEVER DISCLOSE A PERSONALIZED PASSWORD TO ANYONE. Memorize a personalized password -- it is the equivalent of an electronic signature. If a Participant suspects that someone knows their password, they must change it immediately by contacting the Pioneer Customer Service or changing their password themselves online by signing in to their Bonus Bucks account.
  1. The Pioneer Bonus Bucks Card is not a credit card but merely a Bonus Bucks accumulation card. The Pioneer Bonus Bucks Card is the property of Pioneer and it may be revoked at any time by Pioneer in its sole discretion (and at the option of Pioneer, with all accumulated Bonus Bucks to that date cancelled, all without any compensation to the person named as the Card holder in Pioneer records) should a Participant not adhere to and/or abuses the Program and/or its Terms and Conditions.
  1. Only individuals may become Participants of the Program (therefore, non-charitable corporations, businesses, or partnerships cannot become a Participant nor anyone other than an individual). Charities, registered educational institutions and local organizations (referred to herein as a "Registered Entity") who wish to automatically receive Bonus Bucks accumulated in the name of the organization may register for this to occur by writing to Pioneer and providing the necessary background information in that regard; Pioneer reserves the right to decline any such request if in Pioneer's sole opinion the party making the request does not meet Pioneer's criteria for such registration. A Registered Entity may not accrue Bonus Bucks itself; a Registered Entity may only accrue Bonus Bucks as the result of a Participant transferring, linking or assigning Bonus Bucks from the Participant's account to the account of the Registered Entity.
  1. Participants are responsible for notifying Pioneer of any changes in their member profile information such as mailing address, telephone numbers and e-mail address. Any consequences of a failure to notify Pioneer of any such changes are the responsibility of the Participant. To update information, use any of the methods outlined below under the heading "Contacts". Pioneer is not liable for misdirected communications such as mail, telephone or email communications, or any consequences resulting therefrom.

COLLECTION OF BONUS BUCKS

  1. Once a Card is activated, each time eligible purchases (minimum fuel or merchandise purchase amount apply) at a participating location are made, the Participant will earn Bonus Bucks according to the Bonus Bucks Reward Schedules contained in these Terms and Conditions and at the rate posted on the Pioneer Website under the Earn tab on the Bonus Bucks page. Only one Bonus Bucks account number is issued per customer and only one Pioneer Bonus Bucks Card is permitted per customer; however, anyone may use a Participant's primary Card, and in so doing all Bonus Bucks accrued through any such usage will accrue in the name of the Participant named in the process as being associated with that Participant's number.
  1. Customers must present their Card to collect Bonus Bucks before the final transaction payment is taken by the attendant. If a member does not present their Card at the time of purchase, no retroactive recording of Bonus Bucks will occur - therefore, the only opportunity to collect Bonus Bucks is at the time of an actual purchase in conjunction with the presentation of the Card.
  1. Bonus Bucks will be awarded pursuant to the Reward Schedules posted on the Pioneer Website under the Earn tab on the Bonus Bucks page (in the case of any difference between the set of tables posted on the Pioneer Website and tables published elsewhere, the tables posted on the Website shall govern). In the case of purchased merchandise or services other than gas or diesel, Bonus Bucks will be awarded before any taxes, and Bonus Bucks will be awarded on the gross pre-tax price of an item after any discounts. (Tables will temporarily change from time to time when special promotions are offered; please refer to the Earn tab on the Bonus Bucks page for the latest and/or special offer tables in effect). In the case of special offers that award additional Bonus Bucks based on a multiplier of the base reward schedule, selected in-store merchandise and/or services already subject to Earn Extra Bonus Bucks promotions may or may not be excluded from any and all multiplier offers.
  1. Bonus Bucks will not be issued respecting the purchase of the following items/services: natural gas, tobacco purchases, gift cards, prepaid long distance cards, prepaid cellular cards, bill payments, lottery tickets (except where special offers apply), items may or may not be excluded by law and other items specified as exclusions from time to time. Certain items qualify for single Bonus Bucks only in respect of Bonus Bucks accrual and these items will be noted on the Tables appearing in the Earn tab on the Bonus Bucks page.
  1. Bonus Bucks issued on a transaction will be shown on the cash register receipt issued at the time of purchase (in the event that the server used to record Bonus Bucks is unavailable at the time of purchase, Bonus Bucks will be awarded automatically when the system comes available and the new balance will be printed on the next customer receipt).
A Participant's Bonus Bucks account will also be accessible online from the Pioneer website which a Participant is able to access by using the Participant's own unique password. In the event of a discrepancy between the Bonus Bucks issuance and/or balance on a receipt and/or those posted online and/or as contained in Pioneer's own internal database, the information appearing in Pioneer's own internal database will govern (note: the information appearing online is initially generated from the computer system that records individual transactions as they occur at Pioneer stations and for this reason the information appearing online may not accurately reflect the accurate information contained in Pioneer's internal database).
If a Participant has an issue or there is a discrepancy with the number of Bonus Bucks earned on a particular transaction, the Participant has 30 days from the date of the transaction on the receipt to contact Pioneer and report on the matter; after 30 days from the date of a respective transaction, any respective amount of Bonus Bucks appearing in relation to that transaction in Pioneer's Bonus Bucks internal database that has not been questioned by a Participant will be deemed final and will not be changed regardless of the circumstances. If Bonus Bucks were not properly issued or redeemed, Pioneer reserves the right in its sole discretion to adjust the Bonus Bucks in question to correct the matter.
Pioneer, at its sole discretion, reserves the right to take any action or make any decision which in its sole opinion preserves the Bonus Bucks program integrity.
  1. In the event of returns and/or exchanges, Bonus Bucks will be deducted from the Participant's account in the same amount as the number of Bonus Bucks issued for the returned item or service. If the return and/or exchange relates to an item/service acquired through the redemption of Bonus Bucks, all redeemed Bonus Bucks will be returned in Bonus Bucks.
  1. Bonus Bucks are transferable from one Participant to another. Also, accounts of a number of Participants can be linked and in so doing all Bonus Bucks accrued through any such linked usage will accrue in the name of the Participant named as the primary Participant in the linked accounts, which member must be designated at the time of linking. A Participant may assign a percentage of their Bonus Bucks accrued to another Participant or to a Registered Entity and for a period of time (e.g. 10 % of Bonus Bucks accrued over a 6 month period), and the assignment will take place within 24 hours as the individual Bonus Bucks are earned by the Participant. As well, a Participant can link their Bonus Bucks account to a Registered Entity (in which case all that Participant's Bonus Bucks will automatically be transferred to the stated Registered Entity at the time they are earned within 24 hours; no receipt will be issued to the Participant by Pioneer for the transferred Bonus Bucks, be it a charitable receipt or any other type of receipt). To arrange for the transfer or assignment of Bonus Bucks or to link or unlink Participants accounts, Participants can sign in to their account online and arrange for such a transfer, assignment, link or unlink, or Participants can contact us through any of the methods outlined below under the heading "Contacts". Pioneer shall not be liable to any of the Participants in linked accounts or any Registered Entity for any redemption of Bonus Bucks made by the primary Participant.
  1. Bonus Bucks are not divisible in the case of legal disputes including marital disputes such as separation or divorce. Bonus Bucks are automatically forfeited (and the respective account is therefore automatically reduced to zero) at the time a Participant's account is closed, or upon their death, or at the time of their bankruptcy, or if there is no activity on their account for 12 consecutive calendar months, and no credit of any kind will be given to the Participant at any such times for unredeemed Bonus Bucks (and for greater clarity, the foregoing will apply in the event of the death or bankruptcy of the principal Participant in linked accounts such that upon the death or bankruptcy of the principal Participant in linked accounts, all Bonus Bucks accrued by all Participants whose accounts that have been linked will be forfeited). The accumulation of Bonus Bucks does not entitle Participants to any vested rights. Bonus Bucks remain the property of Pioneer at all times.
  1. From time to time, selected in-store merchandise and/or services will be eligible for earning extra Bonus Bucks. In these cases the amount of extra Bonus Bucks advertised in-store will be awarded in addition to the base amount awarded pursuant to the tables posted on the Pioneer Website (in the case of any difference between the set of tables posted on the Pioneer Website and tables published elsewhere, the tables posted on the Website shall govern). These selected items may or may not be excluded from any and all special multiplier offers. Pioneer Energy reserves the right to change these offers at any time at its discretion. Note: Items eligible for earning extra Bonus Bucks are subject to a limited purchase of one item per visit, unless otherwise stated in collateral material.
HOW TO REDEEM BONUS BUCKS
  1. Bonus Bucks are redeemable, pursuant to the terms contained in these Terms and Conditions, at the rate of 1 ¢ per Bonus Buck (for example, 55 ¢ Bonus Bucks has a redeemable value of 55 ¢).
  1. As per applicable tax legislation, GST, PST, HST and any other taxes are calculated and payable by the Participant on the full amount of the purchase price before any reduction for redeemed rewards.
  1. In order to redeem, the Bonus Bucks Card first must be registered. To redeem Bonus Bucks, a Participant must present their registered primary Card at the time of redemption. At that time, the Participant's Bonus Bucks balance will be reduced by the amount of Bonus Bucks redeemed. Bonus Bucks can be redeemed in any amount only if the required amount of Bonus Bucks exists in the Participant's account prior to the purchase/redemption taking place. Bonus Bucks may only be redeemed by the Participant who is the registered Participant of the account holding the Bonus Bucks. In the case of linked accounts, only the Bonus Bucks Card of the primary Participant may be used to redeem the Bonus Bucks. Redemption can only take place if the Bonus Bucks server is fully operational and the Participant's account is in good standings with the program.
  1. Bonus Bucks may be redeemed at any participating Pioneer location for gasoline, diesel, car wash (where applicable) or any merchandise sold at that location and may not be redeemed towards the purchase of coin operated services (such as air and coin car washes) or towards products/services for which redemption is prohibited by law (such as tobacco purchases).
  1. Pioneer may add or delete products and services eligible for Bonus Bucks redemption at any time without notice. Pioneer may substitute products and services eligible for Bonus Bucks redemption with those of equal or greater value at its discretion.
  1. Bonus Bucks have no value except as applied towards the purchase of goods and services offered for sale at participating Pioneer locations and/or the businesses of third party vendors authorized by Pioneer for the distribution and/or redemption of Bonus Bucks (for example, at the businesses of independent third party vendors located at some Pioneer locations) and are not exchangeable for cash and cannot be used to make card payment. Bonus Bucks cannot be sold or purchased and are void if sold for cash or any other consideration.
  1. By redeeming Bonus Bucks, the Participant shall at that time be deemed to have automatically released Pioneer from any and all liabilities and/or claims regarding the redemption and the use of the reward and any loss or damage caused by goods and services supplied as a reward. Pioneer will not be liable in any way for any tax consequences which results to a non-Canadian resident as a consequence of participating in the Program.
GENERAL TERMS AND CONDITIONS
  1. The Pioneer Bonus Bucks Program will terminate at 23:59:59 (local time) on December 31, 2018 (the "Termination Date") and all Bonus Bucks will expire at 23:59:59 (local time) on March 31, 2019 if not redeemed prior to that time. Pioneer reserves the right to extend the Program beyond the Termination Date, or terminate the Program at any time prior to the Termination Date, by posting a revised set of Bonus Bucks Terms and Conditions on its Website, and once posted the revised termination date as contained in the posted new set of Terms and Conditions shall automatically apply. Pioneer may change any of these Terms and Conditions, the Program, or any benefits and procedures at any time (even if this affects Bonus Bucks already accumulated) by posting a revised set of Bonus Bucks Terms and Conditions on its Website, and once posted the revised set of Terms and Conditions shall automatically apply.
  1. In case of a lost or stolen Pioneer Bonus Bucks Card, a new Card will be provided to the Participant upon request at any participating Pioneer station. Any accumulated unredeemed Bonus Bucks balance relating to the old Card can be transferred to the new Card at the time the replacement Card is registered only if the old Card was registered and Pioneer can verify the authenticity of the old Card Participant. The lost or stolen Card will then be de-activated and will not be permitted to redeem Bonus Bucks. Pioneer assumes no liability for Bonus Bucks redeemed by any person(s) prior to the notification to Pioneer's Customer Service that the Pioneer Bonus Bucks Card is lost or stolen (therefore, if any Bonus Bucks are redeemed prior to such notification those unauthorized redeemed Bonus Bucks will not be reinstated to the Participant's new Card); if on the other hand a lost or stolen Pioneer Bonus Bucks Card is used by someone after proper notification to Pioneer, all Bonus Bucks relating to redemptions made by such other person following the date of notification will be credited to the Participant's new Card.
  1. If events beyond Pioneer's control affect Pioneer's ability to operate the Pioneer Bonus Bucks Program, the Program may be suspended or terminated without notice, and Pioneer may restrict or alter any aspect of the Pioneer Bonus Bucks Program without notice at any time and for any reason, and in the event any of the foregoing occurs Pioneer will have no liability whatsoever to any Participant as a result thereof. Pioneer shall be automatically released from all claims by Participants in respect of any Participant's suspension, termination, or any forfeiture of Bonus Bucks, or in respect of any alteration, suspension or termination of the Program.
  1. Pioneer is not responsible for any errors or omissions of any kind, whether in these Terms and Conditions or as the result of any mechanical or technological failure or whether as the result of any human error whether by Pioneer, its employees and agents or by any other person.
  1. These Terms and Conditions will be deemed to be amended only when an authorized revision of these Terms and Conditions is placed on our Website. Pioneer at any time may make enhancements or changes to the Program.
  1. Failure to comply with any of these Terms and Conditions or any violation, fraud, theft or abuse of the Program in any way may result in forfeiture of all Bonus Bucks and possible suspension and/or de-activation of the Participant's Bonus Bucks account without compensation, all the foregoing at the sole discretion of Pioneer and all without notice to the Participant/registered Cardholder.
  1. Pioneer may from time to time extend the Program to other retailers and other loyalty programs in which case Bonus Bucks accruals and redemptions will apply in relation to such other retailers and/or loyalty programs according to the terms and conditions of the Bonus Bucks Program Terms and Conditions as modified in a revision thereto to take account of changes that may be necessary due to the nature of the businesses of such other retailers and/or loyalty programs and how they relate to the Bonus Bucks Program (the revised Terms and Conditions will appear on the Pioneer Website and supersede the previous version of the Program's Terms and Conditions once posted on the Pioneer Website).
GOVERNING LAW
  1. The Program shall be governed by the laws of Ontario and the laws of Canada applicable therein. Any disputes regarding the Program or in any way arising out of participation in the Program, shall be submitted to the courts of Ontario whose courts shall have exclusive jurisdiction to hear such disputes.
PRIVACY OF INFORMATION
  1. Most of the information provided by Participants on the Bonus Bucks registration form, online registration form or to the Pioneer Customer Service representative to join the Bonus Bucks Program will constitute personal information, as that term is defined under the Personal Information and Protection of Electronic Documents Act ("PIPEDA"), for example, your name, gender, marital status, postal address and email address. While Pioneer is collecting such personal information for purposes of administering the Bonus Bucks Program, that information may also be used by Pioneer for market research purposes or to notify you of Pioneer's special promotional offers unless you choose to opt out of receiving promotional material.
Pioneer will not sell any personal information to any third party, though it may be provided to associated third parties in the following circumstances: to administer the Bonus Bucks Program from a technological standpoint (e.g., computer programming companies) or to other loyalty programs to which Pioneer has extended the operation of the Bonus Bucks Program. Sometimes Pioneer enters into business relationships with corporations who do not form part of the Bonus Bucks program but who will nonetheless provide Bonus Bucks program members with various promotional offers (such as discounts if you were to purchase their products or services); in this instance Pioneer will not provide such corporations with your personal information but will provide them with your registered Bonus Bucks Card number so that they can confirm that you are a Bonus Bucks member should you contact them (in and of itself, a Bonus Bucks registration number cannot identify anyone; but if you contact one of these corporations and they request that you confirm your Bonus Bucks registration number and you then provide them with your name, you will then be providing them with personal information which is at that time governed by their privacy policies and not the Pioneer privacy policy).
Participants in the Bonus Bucks Program can choose not to form part of Pioneer's marketing databases or to be contacted for promotional reasons, by checking the appropriate boxes on the registration form, selecting the appropriate response during the online registration process or at any time thereafter by using any of the methods outlined below under the heading "Contacts" or by emailing our privacy officer at privacy@pioneer.ca. By completing and submitting a registration form (paper or online) without the exclusion check-off boxes checked off, Participants are deemed to have consented to the use of their personal information for the purposes described herein. Pioneer assumes no responsibility or liability in the event that a Participant's personal information is accessed by unauthorized persons due to an unauthorized use by third parties of the Participant's password, whether such use resulted from some action or lack of action on the Participant's part (for example, the Participant having lost or misplaced their password or the Participant having given it to a third party or the Participant in some way not adequately protecting the password) or otherwise.
